The US Department of Labor has issued a Final Rule to the Fair Labor Standards Act (hyperlink to this site: https://www.dol.gov/newsroom/releases/whd/whd20240423-0) that increases the minimum salary requirements for some exempt level positions. The first change is scheduled to begin on July 1, 2024, which another change happening January 1, 2025, with automatic updates happening in the future.

What does this mean for employers?

Employers who have classified employees as exempt from overtime should review these new changes to ensure the new salary thresholds are met. It’s also a good time to review the duties of exempt positions to ensure that they are properly classified as exempt.

Litigation related to this new rule is pending, which could result in a delay of or halt to the implementation of these changes.
