MA – Wage Transparency Act

MA – Wage Transparency Act

Massachusetts – Wage Transparency Act – Effective October 29, 2025

The Massachusetts Wage Transparency Act takes effect on October 29, 2025. The Act requires any employer with 25 or more employees in the Commonwealth to disclose the pay range in job postings for applicants, as well as to employees applying for a promotion, transfer, or a new position.  Employees will also have the right to request the pay range for their current position.

Do out-of-state employers have to comply with the law?

Yes, if they meet the following definition – Employer: Any individual, corporation, partnership or other private or public entity, including any agent thereof, who engages the services of an employee for wages, remuneration or other compensation, with the following exceptions:  the US government, cities and towns, public employers as well as certain Personal Care Attendants and Family Childcare Providers.

Additionally, full-time, part-time, seasonal, temporary, and out-of-state remote employees whose primary place of work is in Massachusetts must be included in the headcount, which is calculated annually as an average of the overall payroll periods for that year.

Does disclosure of the pay range apply to jobs located in Massachusetts only?

The law applies to all positions where the primary place of work is in Massachusetts, including those that can be performed remotely to a Massachusetts worksite and remote workers with a primary place of work in Massachusetts.  If either of these situations applies to your organization, posting a pay range is required.

Why is the new law important for all employers?

In New Hampshire, we are surrounded by Maine, Vermont, and Massachusetts. Depending on where your business is located, you may be competing for talent from any one of those states. Be aware that Vermont’s pay transparency laws took effect on July 1, 2025, which means that if you have only one employee based in the state of Vermont, you must disclose wage ranges in job postings and for internal promotions.  If you employ remote workers, they can be located anywhere.  States with transparency laws require that postings include the pay range data.
