An Act to Regulate Employer Surveillance to Protect Workers – becomes effective on or about July 14, 2026 – 90 days after the current legislative session is expected to close.
The law will cover all public and private employers regardless of size and defines employer surveillance as monitoring of an employee by an employer through an electronic device or system.
The Act does not apply to surveillance cameras for security or safety purposes or the use of GPS tracking or other safety devices on vehicles owned by the employer but operated by the employee.
Under the law employers must provide employees with advance notice regarding the use of employer surveillance, before beginning such surveillance, during the interview process of prospective employees, and annually to all current employees.
